A communication from Lord Pearson 29/10/2018

Subject: A communication from Lord Pearson 29/10/2018

Dear All,

You may not have seen my Oral Q tomorrow in the Lords at 14.35:

"Lord Pearson of Rannoch to ask HMG whether they will (1) withdraw their notice under clauses 2 to 5 of Article 50 of the Treaty on European Union, and (2) offer through the Council of Ministers continuing free trade under the World Trade Organisation, and residence and security to European citizens, before agreeing any financial settlement in the Brexit negotiations."

I have offered to collaborate with Martin Callanan, who will be answering for the Government, but so far he hasn't come back to me, and I fear he won't be allowed to say anything useful.

When I've asked this question before, the Govt. has said it can't be done because 'we are a law abiding country'. But I am advised by Ingrid de Frankopan, the top professor of European law, that countries have left international organisations/treaties at least 225 times since the last war, and that it would indeed be legal for us to resile from clauses 2 - 5 of Article 50.

We should at least threaten this?  [And mean it?!]

Malcolm.
